Terms of Use.
The rules for using Nomad Floripa and Nomad Volleyball: your account, the games and what you pay, posting, and what we’re responsible for.
1. Who we are
Nomad Floripa (nomadfloripa.com) and Nomad Volleyball (nomadvolleyball.com) are run by Artifexon Design Ltda, CNPJ 52.422.571/0001-18, Rua Moçambique, 691, São João do Rio Vermelho, CEP 88060-415, Florianópolis, SC, Brazil — “we”, “us”. Contact: artifexon@gmail.com.
We organise casual sports — beach volleyball, football, tournaments — and events in Florianópolis, and run a board where members post places to rent and events. By creating an account, booking a place or posting, you accept these terms and our Privacy Policy. If you don’t, please don’t use the sites.
2. Your account
- You must be 18 or over.
- Use your real name and a WhatsApp number that reaches you, and keep them up to date. One account per person.
- Keep your password to yourself. What’s done with your account is your responsibility, unless someone got in through our fault.
- You can delete your account any time, in your profile.
3. Games, lists and payment
- Places go in the order people sign up. When a game is full you join the waiting list, and move up if someone drops out.
- Every price is shown in reais (R$) before you book. What you pay depends on whether you’re new or have played with us before — decided from your answer when you signed up.
- You pay by Pix to the account the site shows, and upload the proof of payment (comprovante). Your place is confirmed when Rikki checks it. A place not paid by the deadline shown can go to the next person waiting.
- The football month (mensalistas) has its own rules — when to pay and when to confirm each week — shown when you join it.
- We may change the venue, time or number of courts when we have to, and tell you on the site and in the WhatsApp group.
4. Cancellations and credit
- No refunds. The courts and the pitch are booked and paid for ahead, so what you pay isn’t given back.
- If you can’t come: tap Cancel on your place, or tell Rikki on WhatsApp. If someone from the waiting list takes your place, what you paid is kept as credit.
- The football month isn’t refunded, including weeks you miss.
- We call a game off (rain, the venue, too few players): what you paid becomes credit.
- Credit stays on your account and is offered at your next booking. It isn’t paid out in cash.
This doesn’t limit the rights Brazil’s Consumer Code (CDC) gives you by law.
5. Points and free games
You earn points for games and tournaments you play, and can spend them on a free game. How many you earn, what a free game costs, and how long points last without playing are shown in the app. Points have no cash value and can’t be sold or transferred. We may change the rules with notice; we won’t take away points you’ve already earned, except as the rules shown in the app say (for example, points lapsing).
6. Playing safely, and respect
- Sport carries a risk of injury. Play only if you’re fit to, and within your level. We don’t provide medical or accident cover — travel or health insurance is a good idea.
- Look after your own belongings, and follow the venue’s rules (Arena Beach, Flanar, the public courts).
- No harassment, discrimination, violence, threats or abuse — at games, in the WhatsApp groups or on the sites. We can take you off lists, remove you from the groups, or close your account for it.
7. Photos at games
We sometimes take photos and videos at games and events, and share them in the community’s WhatsApp groups, on our social media and on these sites. If you’d rather not appear, tell whoever is taking them, or us — we’ll leave you out, and take down any picture of you when you ask.
8. What you post
- What you post — events, places, “looking for” posts, photos — must be true, legal and yours to share. Real photos and the real price.
- Not allowed: scams, fake or misleading posts, asking for money before a viewing, discrimination, anything illegal, and services that need a professional licence we can’t check (such as legal advice). An estate agent may post a place only as a licensed corretor, with their CRECI number shown and the owner’s written authorisation.
- Rikki checks every post before it goes live, and can decline or take down a post, with a reason.
- You keep the rights to your content, and let us show it on the sites — and share it in our WhatsApp groups and social media to promote it — while it’s up.
- See something wrong? Tap Report, or email us. We act on reports quickly.
9. Rentals and events
Rentals: we are a free noticeboard, not an estate agency (imobiliária) or an estate agent (corretor de imóveis), and we don’t act as one. We charge no fee and take no commission. We don’t negotiate for anyone, show places, pick one out for you, draw up contracts, collect rent or hold deposits: hosts and renters deal with each other directly, and the agreement is between you and the host, under Brazilian law (Lei nº 8.245/1991).
We don’t own the places or vouch for them. Rikki’s approval means a post looked right to him and its host said it meets the Nomad standard; a Verified mark means only that Rikki has seen the place or knows the host. An agent who posts a place acts for themselves, under their own CRECI. If you want someone to act for you, hire a licensed corretor (check their CRECI), and have someone qualified read your contract. See a place before you pay anything.
Events: an event posted by another member is theirs to run — the organiser is responsible for it, for its safety and for any tickets they sell.
10. Guides and partners
The visa guide and other information here are general information, not legal or professional advice. Rules change: check the official sources before you act.
Partner offers — like the Arena Beach coupon — are given by the partner, on its terms. Partners may give us benefits, such as court credit, when you use their offers.
11. What we’re responsible for
We work to keep the sites running and accurate, but can’t promise they’ll always be available or free of errors, and we may change or stop features. We’re not responsible for what other members, hosts, organisers or venues do, or for agreements between members. Nothing in these terms takes away the rights you have under Brazil’s Consumer Code (CDC).
12. Ending, changes and the law
- We may suspend or close an account that breaks these terms, and will tell you why.
- When these terms change we update the date at the top, and tell you on the site or in the WhatsApp group if the change matters. Using the sites after that means you accept the new terms.
- These terms are governed by Brazilian law. Talk to us first — we’d rather sort it out. If it comes to court, you can use the courts where you live (CDC art. 101); otherwise the courts of Florianópolis, SC.
- These terms are also in Portuguese; if the two differ, the Portuguese version prevails.
